IFIX CELLFONE TERMS OF SERVICE:

By submitting a work request form online or in person, you (“Customer”) agree to the following Terms of Service with IFIX CELLFONE (“Company”).


1. Authorization of Work

Customer grants permission to IFIX CELLFONE and its agents to perform necessary repairs, replacements, or modifications to the device (“Service”). The scope of work will be discussed and agreed upon before Service begins. If any agreed-upon terms conflict with this Agreement, this Agreement will take precedence.


2. Payment, Refund, and Substitute Service

  • Payment is due in full at the time of Service unless otherwise agreed in writing.
  • Service fees are binding and due regardless of the success of the repair, except as stated below.
  • If the Company is unable to complete the Service due to factors beyond its control, the Customer may be eligible for a partial refund at the Company’s discretion.
  • If the Customer is unsatisfied with the Service, the Company may, at its sole discretion, provide a refund or reattempt the repair. However, the Company is not obligated to issue a refund.

3. Warranty

  • The Company warrants its workmanship and replacement parts for 90 days from the date of Service.
  • The warranty covers defects in workmanship and replacement parts only.
  • The warranty is void if the device has been tampered with, exposed to physical or liquid damage, or serviced by another party after the repair.
  • If a defect is found within the warranty period, the Company will attempt to resolve the issue at no additional cost.
  • If the defect is due to Customer misuse, abuse, or prior unauthorized repairs, the Company is not liable for repairs, and the warranty does not apply.

4. Water-Resistant Devices Disclaimer

  • The Company cannot guarantee that a water-resistant device will remain water-resistant after repair.
  • Opening the device may compromise its original water resistance.
  • Customer assumes full responsibility for any damage or loss caused by loss of water resistance after the repair.

5. Right to Refuse Service

The Company reserves the right to refuse Service for any reason, including but not limited to:

  • Devices deemed beyond repair.
  • Situations where the repair poses a risk to the device or technician.
  • Suspected stolen or unauthorized devices.

6. Abandonment of Device

  • Customers must pick up their repaired device within 14 days after being notified of completed Service.
  • If the device is not claimed within 14 days, the Company will issue a final written notice via email or phone.
  • If unclaimed within 30 days of repair completion, the device will be considered abandoned, and the Company may dispose of or sell the device to recover unpaid fees.
  • Customer agrees to hold the Company harmless for any claims related to abandoned property.

7. Customer Responsibilities and Acknowledgments

Customer acknowledges and agrees that:

  1. Ownership of Device: The Customer is the legal owner of the device submitted for repair. If not, the Customer assumes full liability for any claims arising from unauthorized repairs.
  2. Manufacturer Warranty: Repairs performed by the Company may void the manufacturer’s warranty. The Company is not responsible for any manufacturer warranty claims.
  3. Data Backup: The Customer must back up all important data before Service. The Company is not responsible for any data loss.
  4. Unclaimed Items: Any unclaimed items left with the Company beyond 30 days will become Company property, and unpaid balances may be pursued legally.
  5. Previous Repairs: The Customer must disclose any previous repairs performed on the device. If damage occurs due to prior faulty repairs, the Company is not liable, but will present resolution options for the Customer.

8. Waiver of Liability and Limitation of Damages

  • The Company is not responsible for loss of data, software corruption, or component failure during or after repair.
  • The Company is not liable for indirect, incidental, or consequential damages, including loss of use, loss of profit, or any third-party damages.
  • CUSTOMER EXPRESSLY WAIVES ANY CLAIMS FOR LIABILITY, EXCEPT AS REQUIRED BY LAW.
  • If the Company is found liable for any issue, its maximum liability is limited to the amount paid for the Service.

9. Indemnification

The Customer agrees to indemnify and hold harmless the Company, its employees, and representatives from any claims, liabilities, or damages resulting from:

  • Misuse or subsequent damage to the repaired device.
  • Any legal claims arising from unauthorized use or ownership of the device.
  • Any software or data issues occurring after Service.

10. Termination of Agreement

  • The Company may terminate this Agreement at any time by providing written notice to the Customer.
  • If the Agreement is terminated, the Company will return the device and cease further repairs.
  • The Customer may terminate the Agreement before the Service begins. If terminated after work has started, the Customer may still be responsible for service fees.

    11. Entire Agreement & Severability

    • This Agreement is the entire agreement between the Company and the Customer and supersedes all prior communications.
    • If any provision of this Agreement is found to be unenforceable, the remaining terms shall still apply.

    Acknowledgment

    By submitting a work request, the Customer confirms they have read, understood, and agreed to these Terms of Service.
